1. Introduction
Welcome to PhonePi MCP. These Terms of Service ("Terms") govern your access to and use of the PhonePi MCP application and services. By accessing or using PhonePi MCP, you agree to be bound by these Terms. If you do not agree to these Terms, do not use PhonePi MCP.
2. No Data Collection
PhonePi MCP does not collect any personal data or usage information. The service operates entirely on your local devices without requiring any sign-ups or accounts. All operations are performed locally within your infrastructure, ensuring complete privacy and data security.
3. Definitions
- "Service" refers to the PhonePi MCP application, its AI integration capabilities, and any related services.
- "User" refers to the individual accessing or using the Service.
- "Company" (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to PhonePi MCP.
- "Content" refers to any data, information, text, graphics, photographs or other materials uploaded, downloaded or appearing on the Service.
4. Use of the Service
4.1 Eligibility
You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.
4.2 AI Integration
PhonePi MCP integrates with various AI assistants through the Model Context Protocol (MCP). You understand and agree that:
- Your AI assistants will have access to phone features you explicitly grant permission for
- You are responsible for managing AI permissions and access levels
- The Company is not responsible for actions taken by AI assistants through the Service
- You should review and understand the privacy policies of connected AI services
- For your security, SMS and phone call requests will open your phone's default messaging and phone apps rather than executing directly
4.3 Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Infringe the rights of any third party
- Upload or transmit viruses, malware, or any malicious code
- Interfere with or disrupt the Service or servers or networks connected to the Service
- Collect or store personal data about other users without their consent
- Use the Service for any unauthorized or illegal purpose
5. Content and Data
5.1 Local Processing
All data processing occurs locally on your devices. We do not store, transmit, or have access to any of your personal data, phone content, or usage information.
5.2 Content Responsibility
You are solely responsible for any content processed through the Service and the consequences of using AI assistants with your phone. We do not monitor or control AI-phone interactions and expressly disclaim any liability in connection with such usage.
6. Open Source Software
PhonePi MCP is open source software. By using the Service, you agree to comply with the terms of our open source license. The source code is available on GitHub and you are free to inspect, modify, and distribute it according to the license terms.
7. Intellectual Property
The Service and its original content, features, and functionality are owned by PhonePi MCP and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws, while respecting the terms of our open source license.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE CREATORS, DEVELOPERS, OR CONTRIBUTORS OF PHONEPI MCP BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE.
10. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
11. Governing Law
These Terms shall be governed and construed in accordance with the laws of New Delhi, India, without regard to its conflict of law provisions.
